Explanation of the Consignment Process |

SMIS will inspect the item(s) for quality and cleanliness and take possession of the item for the duration of auction. |

SMIS will take quality photographs and write an accurate description of item(s). |
* |
SMIS will research eBay, at Consignors request, for similar items, to assure proper pricing. |
* |
SMIS will start the auction(s) and handle all aspects of the sale including correspondence with potential bidders. |
* |
SMIS will collect payment from the winning bidder ("Buyer") at the end of the auction and will ship the item(s) in a timely manner,
once funds have been cleared. |
* |
SMIS will follow-up the sale by contacting the Buyer to make sure they are satisfied with the transaction. |
* |
Once SMIS and Buyer are satisfied with the transaction, payment will be made to the Consignor by check. |
* |
SMIS will return unsold item(s) to the Consignor after the closing date of final listing. If item(s) are unclaimed for 21 days SMIS will dispose of said item(s), at their discretion. |

Once Items are Listed |

If an instance arises that the Consignor demands the item(s) be pulled and the auction cancelled, the Consignor will pay a cancellation fee of $75. The auction will not be cancelled and item(s) will not be surrendered to Consignor until this fee is paid in cash. Auctions are not cancelable when they have less than 24 hours to run. |
Consignor agrees not to bid on auctions that SMIS has listed for them on eBay. If such an instance occurs the Consignor agrees to pay all fees and commissions associated with that auction, (if the Consignor is the high bidder), plus a $75 fine AND accepts the possibility of not being able to use the auction services of SMIS in the future. |
Pricing and Fees |
SMIS commission is fifteen percent (15%) of final sales price. eBay and PayPal fees will depend on final sales price. |
SMIS's eBay account will incur charges for listing items on their site. Any services or upgrades requested by the Consignor will carry additional fees. These fees are the responsibility of the Consignor to pre-pay before the item is accepted for listing. |
Payment to the Consignor wll normally be made within 30 days of receipt of funds from the ("Buyer"). Payment will include a printed copy of the completed auction that will serve as proof of the sale of the item and an invoice detailing fees subtracted. |
Shipping and handling charges associated with the auction will be paid by the Buyer to SMIS to cover postage, delivery confirmation, and packaging materials. These charges are independent to the selling price of the item. |

| EXAMPLE 1: Item sells for $30 $30 - ($4.50 commission) - ($2.37 eBay fee) - ($1.17 PayPal fee) = $21.96 to seller. EXAMPLE 2: Item sells for $100 $100 - ($15 commission) - ($4.82 eBay fee) - ($3.20 PayPal fee) = $76.92 to seller+A4. Fees for eBay & PayPal generally decrease as the final sales price increases. The EXAMPLES are estimates only. |
General Statements |
| Smoky Mountain Internet Sales cannot guarantee that the Consignor's item(s) will sell. If an item does not sell, SMIS will re-list the item(s) one additional time, at Consignor's request, with no additional SMIS Listing Fee from the Consignor. Consignor will need to pay the additional eBay listing fee as shown on original contract. SMIS may contact the Consignor to discuss combining individual items into lots to attract buyers. This could result in additional Listing Fees. Item(s) not claimed within 21 days from the ending date of the final listing will become the property of SMIS. |
All returned checks will be assessed a $40 fee. |
